1. Acceptance of Terms

By accessing mobintix.com (the "Site") or using software products provided by Mobintix Technologies (OPC) Private Limited ("Mobintix", "we", "us"), including Mobintix DailiGo and Mobintix SalesUp (web and mobile applications), you agree to these Terms of Service. If you do not agree, do not use the Site or products.

If you use a product on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Services

Mobintix provides:

Mobintix DailiGo — SaaS for recurring delivery operations (subscriptions, daily usage tracking, billing workflows, team access) via web admin and mobile apps
Mobintix SalesUp — FMCG field-force platform (attendance, GPS route footprints, visits, orders, territories) via web and mobile apps
Other commercial products such as Billing & Inventory POS and Digital Wallet platforms, as offered
Custom software development and consulting
Open-source–oriented packages and documentation
Marketing website content and resources

Order forms, subscription plans, or separate written agreements may add product-specific commercial terms. If there is a conflict, the signed order or agreement controls for commercial terms.

3. Accounts and workspaces

You must provide accurate registration information and keep credentials confidential.
Workspace administrators are responsible for inviting users, assigning roles, and the business data entered into their tenant.
You must not share accounts in a way that bypasses role or license limits.
We may suspend access for security incidents, abuse, non-payment, or legal risk.

4. Acceptable use

You agree not to:

Use the Site or products for unlawful purposes
Attempt unauthorized access to systems, accounts, or data
Interfere with service availability or security
Upload malware or abusive content
Scrape or extract data except as allowed by your workspace permissions and applicable law
Misrepresent identity or affiliation
Use SalesUp location or camera features to monitor individuals unlawfully or outside your organization's legitimate workplace purposes and notices

5. Product-specific terms

5.1 Mobintix DailiGo

DailiGo is provided for business use by delivery operators and their invited users. You are responsible for the accuracy of subscriptions, usage entries, and billing records you or your staff enter. Mobile and web clients connect to Mobintix-hosted APIs; availability depends on network connectivity and your plan status.

5.2 Mobintix SalesUp

SalesUp may collect location and camera/photo data for attendance and route management as configured by your organization. Employers/admins must ensure they have a lawful basis and appropriate employee notice for workplace monitoring features. Field users should grant only the permissions they are comfortable with; declining permissions may limit features.

5.3 Other commercial products

Use of Billing & Inventory POS, Digital Wallet, and similar products may be subject to separate license or deployment agreements provided at purchase.

6. Intellectual property

The Site, products, branding, and related materials are owned by Mobintix or its licensors. Subject to your subscription or license, we grant you a limited, non-exclusive, non-transferable right to use the products for your internal business purposes during the term.

You retain ownership of your business content. You grant Mobintix a license to host, process, and display that content solely to provide and secure the service.

Open-source packages are licensed under the terms published with each package (for example MIT), unless stated otherwise.

7. Fees and subscriptions

Paid plans are billed as described in your order, invoice, or admin billing screens. Unless stated otherwise, fees are non-refundable once a billing period starts. We may change pricing with notice for renewal periods.

8. Third-party services

Products may integrate with third-party infrastructure (hosting, email, maps, analytics, payment providers). Your use of those services may also be governed by their terms and privacy policies.

9. Privacy

Personal data is handled as described in our Privacy Policy. For store listings and in-app legal links, the Privacy Policy at https://www.mobintix.com/privacy applies to DailiGo and SalesUp unless a product-specific addendum is provided.

10. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.

11. Limitation of liability

To the maximum extent permitted by law, Mobintix shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data, arising from use of the Site or products.

Our aggregate liability for claims relating to a product subscription in any twelve-month period shall not exceed the fees paid by you to Mobintix for that product in that period, except where liability cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Mobintix and its officers, directors, employees, and agents from claims, damages, and expenses arising from your content, your misuse of the products, or your violation of these Terms or applicable law (including unlawful workplace monitoring).

13. Suspension and termination

You may stop using the products at any time. We may suspend or terminate access for breach, legal risk, or non-payment. Upon termination, your right to access the service ends; sections that by nature should survive (IP, liability, indemnity, governing law) will survive.

14. Governing law

These Terms are governed by the laws of India. Courts in Patna, Bihar, India shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply.

15. Modifications

We may update these Terms by posting a revised version on this page with an updated "Last updated" date. Material changes to paid subscriptions will be communicated through reasonable means where required. Continued use after changes become effective constitutes acceptance where permitted by law.
